Terms of Service

1. Agreement to these Terms
These Terms of Service ("Terms") govern your access to and use of ducksurfer.com and DuckSurfer's hosting, website, domain, DNS, email, backup, and related services (collectively, the "Services"). DuckSurfer is operated by Magnus Turner, a Michigan sole proprietor. By creating an account or using the Services, you agree to these Terms and our Privacy Policy.
You must be at least 18 years old and able to form a binding contract. If you use the Services for an organization, you represent that you have authority to bind it to these Terms.
2. Service availability
Available features depend on your selected plan, account status, location, and the services DuckSurfer currently supports. Domain search results are informational until you complete checkout and DuckSurfer confirms registration.
Features may change, be limited, or be suspended as we improve the Services. We may add, remove, limit, or discontinue a feature. Unless we expressly agree otherwise in writing, the Services do not include a service-level or uptime guarantee.
3. Accounts and security
You must provide accurate account information, keep your credentials confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account, except to the extent caused by DuckSurfer's breach of these Terms or applicable law.
We may require email verification, impose usage limits, or take reasonable steps to protect the Services, our infrastructure, and other users.
4. Your content and responsibilities
You retain ownership of the files, code, text, images, domain records, mailbox content, prompts, and other material you submit to the Services ("Customer Content"). You grant DuckSurfer a limited, non-exclusive license to host, copy, transmit, process, back up, and display Customer Content only as needed to provide, secure, maintain, and improve the Services.
You represent that you have the rights and permissions needed to use and publish Customer Content. You are responsible for your websites, domain settings, email use, backups you download, and compliance with laws that apply to your business and visitors.
5. Acceptable use
You may not use the Services to:
- break the law, infringe intellectual property or privacy rights, or facilitate fraud;
- host or distribute malware, phishing pages, stolen credentials, or deceptive content;
- send spam, unsolicited bulk messages, or abusive email;
- attack, scan, overload, disrupt, or gain unauthorized access to any system;
- circumvent security controls, usage limits, or access restrictions;
- host content that exploits children or promotes violence against a protected person or group; or
- use the Services in a way that creates material risk for DuckSurfer, its infrastructure, or other users.
We may remove content or suspend access when reasonably necessary to address abuse, security threats, legal requests, or violations of these Terms.
6. Domains, DNS, email, and third-party services
Domain availability, DNS propagation, certificate issuance, email delivery, and third-party systems can change or fail for reasons outside DuckSurfer's control. You are responsible for confirming important domain and DNS changes and maintaining any domain registration held outside DuckSurfer.
DuckSurfer-purchased domains are registered for the term shown at checkout. Registrar automatic renewal is disabled unless DuckSurfer completes a separately authorized renewal payment. We will display the known expiration date and available renewal action in your account. You remain responsible for renewing or transferring a domain before it expires.
Some features rely on third-party providers, such as payment processors, domain registrars, DNS and infrastructure providers, email delivery services, and AI model providers. Your use of those integrations may also be subject to the provider's terms.
7. AI-enabled features
AI-generated suggestions or output may be inaccurate, incomplete, or similar to content generated for others. You must review output before publishing or relying on it. DuckSurfer does not guarantee that AI output is correct, unique, or suitable for a particular purpose.
8. Fees, renewals, cancellation, and refunds
Creating an account does not start billing. Before you authorize a paid Service, DuckSurfer will show the price, billing period, applicable taxes, renewal terms, and any trial terms. You authorize DuckSurfer and its payment processor to charge the payment method you provide for amounts shown at checkout.
You may cancel a paid subscription through the account portal or by contacting support. Unless checkout states otherwise or applicable law requires it, cancellation stops future renewal and does not create a refund for a period already paid. Domain registration and renewal charges are generally non-refundable once submitted to a registry or registrar.
9. DuckSurfer property and feedback
The Services, software, branding, designs, and documentation—excluding Customer Content—are owned by DuckSurfer or its licensors and protected by law. These Terms do not transfer ownership to you. If you provide feedback, you allow us to use it without restriction or compensation.
10. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access for a material breach, nonpayment, abuse, security risk, legal requirement, or discontinuation of the Services. When practical, we will provide notice and an opportunity to export Customer Content. You should maintain your own current backups; access to Customer Content may end when an account is terminated.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." DUCKSURFER DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUCKSURFER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
DUCKSURFER'S TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DUCKSURFER FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100. These limits do not apply where prohibited by law.
13. Indemnification
To the extent permitted by law, you will defend and indemnify DuckSurfer and its personnel from third-party claims arising from your Customer Content, your unlawful or unauthorized use of the Services, or your material breach of these Terms. This obligation does not apply to the extent a claim was caused by DuckSurfer.
14. Governing law
These Terms are governed by the laws of the State of Michigan and applicable United States federal law, without regard to conflict-of-law principles. Courts located in Michigan will have exclusive jurisdiction over disputes, except where applicable consumer law requires otherwise.
15. Changes and general terms
We may update these Terms to reflect changes to the Services, law, or our practices. We will post the revised Terms and update the date above. If a material change applies to registered users, we will provide reasonable notice through the Services or by email. Continued use after the effective date means you accept the revised Terms.
If any provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; DuckSurfer may assign them as part of a merger, financing, reorganization, or sale of the relevant business.
